Who We Are
Thingaling ("the Platform", "we", "us") is a personal project operated by an individual based in Saskatchewan, Canada. Thingaling is a community-driven platform where users submit images of things — products, characters, foods, places, and more — and vote on them in head-to-head duels.
By using Thingaling, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Platform.
Who Can Use Thingaling
You must be at least 13 years old to create an account. By registering, you confirm that you meet this requirement.
If you are under 18, you confirm that you have your parent or guardian's permission to use the Platform.
We do not knowingly collect personal information from individuals under the age of 13. If we become aware that such information has been collected, we will take steps to delete it.
Your Account
- You are responsible for keeping your account credentials secure.
- You are responsible for all activity that happens under your account.
- You must provide accurate information when registering.
- You may not use bots, scripts, or automated methods to access or interact with the Platform without our permission.
We reserve the right to deny access to the Platform, or suspend or terminate accounts, at any time, with or without notice.
Account Termination and Data
You may delete your account at any time by contacting us or using the account deletion option in your settings.
We may suspend or terminate your account at our discretion if you violate these Terms.
Upon account termination:
- Your access to the Platform will be revoked
- Your submitted content may remain on the Platform in anonymized form to preserve community voting history and leaderboard integrity
- Virtual currency (Goodies), items, and account progress may be forfeited
- We may retain certain data as required for legal, security, or operational purposes
We are not obligated to restore accounts or data after termination.
Submitting Things — What You Can and Cannot Post
Thingaling allows users to submit images ("Things") for community voting. By submitting a Thing, you represent and warrant that:
- You have the right to use the image you are submitting, whether because you created it, you have permission from the rights holder, or your use is otherwise lawful
- You are submitting the image for community voting and commentary purposes, not for commercial reproduction or distribution
- Your submission does not infringe any third-party copyright, trademark, or other intellectual property rights
- You will not submit content that is pornographic, sexually explicit, or involves minors in any sexual or exploitative context
- You will not submit content that depicts or encourages real-world violence, self-harm, or illegal activity
- You will not submit content that harasses or targets any individual
- You will not submit spam, malware, or deceptive material
- Your submission does not violate any applicable Canadian federal or provincial law
You are solely responsible for any content you submit and the legal consequences of posting it. Thingaling does not verify or guarantee that users have the necessary rights to submitted content.
Before uploading or replacing a Thing image, you must confirm that you own the image, have permission or a licence to use it, or that the image is public-domain or otherwise lawful to upload. Finding an image through a search engine or social-media post does not, by itself, give you permission to use it.
You may not attempt to manipulate, exploit, or interfere with the Platform, including voting systems, rankings, rewards, or Marketplace features.
We do not guarantee the accuracy, completeness, or reliability of user-submitted content. The presence of any content on the Platform does not imply endorsement by Thingaling.
We reserve the right to remove any content and suspend any account at our discretion.
Who Holds a Thing — Not Ownership of IP
When you submit a Thing to Thingaling, you become the Holder of that card. Being the Holder means:
- You submitted the Thing and it is associated with your account
- You may earn in-platform rewards based on how your Thing performs in duels
- You have certain controls over your submission, such as editing its description
Being the Holder does not mean:
- You own the intellectual property depicted in the image
- You have any rights over the brand, character, product, or work shown
- You can prevent others from referencing or discussing that subject on the Platform
All third-party brands, characters, logos, and works remain the property of their respective owners. Thingaling does not claim ownership of any intellectual property depicted in user submissions.
License to Us
You keep whatever rights you have in content you submit.
By submitting content to Thingaling, you grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, modify solely for formatting, technical, or operational purposes, store, and distribute your submission for the purpose of operating, improving, and promoting the Platform.
This license continues for a reasonable period after deletion to allow us to maintain backups, logs, and historical records, including completed duels and leaderboard data.
Copyright Complaints and Image Removal
Thingaling takes copyright concerns seriously. Images are submitted by users, and we do not pre-screen every submission for copyright ownership. We provide a documented complaint, review, and image-removal process and will also comply with any obligations that apply to us under Canadian law.
If you are a copyright holder and believe your work has been used without authorization:
Use the Request Copyright Takedown button in the Legal tab of the affected Thing, or contact support@thingaling.net. Please provide:
- Your full legal name, email address, and mailing address
- Your company or organization, if applicable
- Whether you are the copyright owner or authorized to act for the owner
- Identification of the copyrighted work and, where available, a URL or other supporting evidence
- Identification of the affected Thing and the date and time you observed the image
- An explanation of the claimed infringement
- A good-faith statement that the disputed use is not authorized by the owner, its agent, or the law
- A statement that the information is accurate and that you are the owner or authorized to act for the owner
- Your electronic signature
What happens after a request is submitted:
- We create a timestamped record and provide the claimant with a request number.
- We review the information and may ask for additional details.
- We may temporarily hide the image while the request is reviewed.
- If we uphold the request, we disable public access to the image and notify the uploader.
- If we reject or reverse the request, we may restore the image.
When an image is hidden or removed, the Thing's title, votes, ELO score, comments, and other community data may remain available with an abstract colour replacement. We may permanently delete the image, the Thing, or associated data when appropriate or legally required.
Submitting a request does not establish that infringement occurred. Thingaling may consider the information supplied by the claimant and uploader, applicable licences and exceptions, and any court order or other legal process. Only a court can make a binding determination of copyright infringement.
Repeat infringers:
An upheld request may result in a copyright strike. Two active strikes may result in a 90-day image-upload restriction. Three active strikes may result in a permanent image-upload ban. We may impose different or additional restrictions, suspend an account, or terminate an account based on severity, repeat conduct, legal requirements, or abuse of the Platform.
Misuse of the process:
Do not knowingly submit false, misleading, fraudulent, or abusive copyright requests. We may reject requests, restrict access, preserve relevant records, and take other appropriate action when this process is misused.
Virtual Currency and Paid Features
Thingaling offers optional paid features, including membership tiers and a virtual in-platform currency ("Goodies").
Please read this section carefully.
- Goodies are virtual currency. They have no real-world cash value and cannot be redeemed, transferred, or refunded for real money.
- Membership purchases are for digital access to cosmetic and quality-of-life features. They do not affect votes, rankings, or leaderboard outcomes. To the extent permitted by applicable law, all purchases are final. Memberships are generally non-refundable once the membership period has begun, except where required by applicable law.
- All prices are displayed in Canadian dollars (CAD) unless otherwise noted.
- We reserve the right to change pricing, features, modify, or discontinue any part of the Platform at any time without liability. If we discontinue a paid feature you have already purchased, we will make reasonable efforts to provide a fair remedy.
- We may adjust, reset, or remove virtual currency balances if necessary to address bugs, abuse, or system errors.
- Virtual items, Goodies balances, and account progress may be lost if your account is suspended or terminated due to a violation of these Terms.
Marketplace and User-to-User Transactions
Thingaling may allow users to trade virtual or digital items between each other using Goodies, the Platform's virtual currency ("Marketplace").
- All Marketplace transactions use Goodies only. No real-world money changes hands between users through the Marketplace.
- All transactions are strictly between users. Thingaling is not a buyer, seller, or intermediary in these transactions.
- Goodies spent in Marketplace transactions are non-refundable. We do not provide dispute resolution between users.
- We do not guarantee the quality, accuracy, or availability of any item listed.
- We reserve the right to remove listings, reverse virtual transactions, or restrict Marketplace access at our discretion.
- We may intervene in transactions where necessary to prevent fraud, abuse, or violations of these Terms.
Use the Marketplace at your own risk.
No Agency or Partnership
Nothing in these Terms creates a partnership, joint venture, agency, franchise, or employment relationship between you and Thingaling. You have no authority to make representations or commitments on our behalf.
Moderation and Enforcement
We use automated tools and human review to moderate content. We reserve the right — but are not obligated — to:
- Remove or replace content that violates these Terms
- Hide, flag, or restrict content under review
- Suspend or permanently ban accounts
- Cooperate with law enforcement if required
We will try to act fairly, but moderation decisions are at our sole discretion. Users may contact us to request a review of a moderation decision. We are not obligated to reverse any decision, but may do so at our discretion.
Disclaimer of Warranties
Thingaling is provided "as is" and "as available" without warranties of any kind, either express or implied.
We do not guarantee that the Platform will be:
- Always available or uninterrupted
- Free of bugs, errors, or security vulnerabilities
- Suitable for any particular purpose
We do not guarantee the accuracy, completeness, or reliability of any content on the Platform, including user-submitted Things.
We may modify, suspend, or discontinue the Platform (or any part of it) at any time without notice.
Use the Platform at your own risk.
Limitation of Liability
To the fullest extent permitted by applicable Canadian law, we will not be liable for:
- Loss of data, Goodies, or account progress
- Any indirect, incidental, or consequential damages arising from your use of the Platform
- Actions or content posted by other users
Our total liability to you, for any reason, will not exceed the amount you paid to us in the 12 months prior to the event giving rise to the claim.
Indemnification
You agree to defend, indemnify, and hold harmless Thingaling and its operator from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising from:
- Your use of the Platform
- Your submitted content
- Your violation of these Terms
- Your violation of any applicable law or third-party rights, including intellectual property rights
This obligation survives the termination of your account.
Changes to These Terms
We may update these Terms from time to time. We may also modify or discontinue any part of the Platform at any time without liability. If we make significant changes to these Terms, we will notify you by posting a notice on the Platform or by email.
Your continued use of the Platform after changes are posted means you accept the updated Terms.
Governing Law
These Terms are governed by the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein. Any disputes will be resolved in the courts of Saskatchewan.
